ATTORNEY GENERAL HERRING SUES VIRGINIA BEACH-BASED SEA-THRU WINDOWS FOR DEFRAUDING HOMEOWNERS

~ Suit seeks restitution for Virginians who had their money taken by Sea-Thru but did not get their window installation completed, or whose "lifetime warranty" was not honored ~

RICHMOND (July 14, 2017) -Attorney General Mark R. Herring announced today that he has filed a lawsuit against Sea-Thru Windows, Inc., a Virginia Beach-based window seller and installer, and its President and sole owner, Jeffery C. Pesich, for allegedly absconding with tens of thousands of dollars of customers' money in violation of the Virginia Consumer Protection Act. The suit seeks restitution for homeowners whose money was taken without work being completed, as well as for homeowners whose supposed "lifetime warranty" was not honored by Sea-Thru. 

"When Virginians spend hundreds or thousands of dollars on their homes, they should get what they pay for," said Attorney General Herring.  "Contractors who defraud homeowners can lose their license, as Sea-Thru Windows has, and my Office can and will help homeowners seek restitution for what they are owed. We need to know just how rampant the misconduct may have been, so I encourage anyone who was a victim to contact my Consumer Protection Section as soon as possible."

Sea-Thru Windows was a licensed contractor selling windows and window installations to Virginia homeowners, businesses, and houses of worship out of offices in Norfolk, Virginia Beach, Chesapeake, and Midlothian. Attorney General Herring's lawsuit, filed in the City of Virginia Beach Circuit Court, alleges that Sea-Thru and Mr. Pesich violated the Virginia Consumer Protection Act by:

• spending customers' money on personal items or on other business obligations rather than purchasing windows for installation in consumers' homes;
• making false statements and unfulfilled promises about when windows would be delivered and installed;
• misrepresenting to homeowners that Sea-Thru would repair windows covered by a lifetime warranty; and,
• failing to appropriately tell homeowners about their right to cancel home sales within three business days.

The Virginia Board for Contractors revoked Sea-Thru's contractor's license in March 2017 in part for failing to complete promised work and for failing to comply with the terms of its own contracts with homeowners. 

The lawsuit asks the court to bar Sea-Thru from violating the Virginia Consumer Protection Act and to award restitution to the affected consumers.  The suit also seeks an award of civil penalties of up to $2,500 per willful violation, and reimbursement of the Commonwealth's costs, reasonable investigative expenses, and attorneys' fees.
